We will be hosting a conversation about the "Voluntary" aspect of mediations. As more mediation panels for "mandated" mediations are popping up everywhere, are we, as mediators, still upholding the notion that mediations are meant to be voluntary? Were they ever really meant to be voluntary? Should we be changing our approaches? Is encouraging parties to settle when they have given you their last, best, and final still within the realm of voluntariness?
