The pandemic taught us that we can effectively mediate online and it transformed how we negotiate. First, it taught us how to negotiate without threats. Threats of trial were hollow. Threats to leave mediations were laughable. And threats of physical intimidation were limited by our equal-sized squares on a screen. Second, it taught us how to exchange needed information – without courts. Third, it taught us we can reach agreements faster among friends than between enemies. In the process, this transformation opened the doors to an approach to early dispute resolution that was not viable before the pandemic. Sid will explain.
Sid Kanazawa is a full-time mediator/arbitrator with ARC (Alternative Resolution Centers LLC) https://www.arc4adr.com/sidney_kanazawa.php who understands disagreements are an essential part of an evolving free society but is equally passionate about promoting creative ways to resolve conflicts in a just, speedy, and inexpensive manner. We are all in this together and are at our best when we work together. During the pandemic, within days of the shutdown, Sid pivoted to online mediations, helped isolated parties exchange “sufficient knowledge” (without court assistance), and resolved more than 100 cases online, learning invaluable lessons along the way. He is a graduate of the University of Hawaii (B.Ed.), University of Southern California (J.D.), and the negotiation and mediation programs at Harvard University (Program on Negotiation), Pepperdine University (Straus Institute for Dispute Resolution), Los Angeles Superior Court, Edelman Children’s Court, Early Dispute Resolution Institute, and the United States District Court for the Central District of California. Sid is a prolific author/speaker/teacher, is admitted to practice in Hawaii and California, and has been a National Institute for Trial Advocacy (NITA) instructor and program director for more than 30 years.
