Winning at Mediation. One winner, one loser. Some attorneys haven't studied ADR in law school or gotten the memo on the benefits of mediation. They still see themselves as gladiators and the mediation table as just another battleground where the goal is the same-- win while opposing counsel and their client lose. Many of us have had mediations in which a/the major impediment to reaching an agreement was the attorney(s).
