The construction industry is no stranger to disputes. In cases where parties frequently invest billions of dollars into complex infrastructure and engineering projects, the need to efficiently resolve disputes before they give rise to formal arbitration/litigation is paramount. To do so, the construction industry has developed a unique pre-arbitration/litigation dispute resolution method commonly known as a dispute board. While dispute boards can take a broad range of forms, they commonly enable parties to test their positions before a neutral body and receive feedback concerning the merits of their claims/defenses. The upcoming presentation will focus on how the construction industry has used dispute boards and whether other industries might be able to utilize this model for their own purposes.
- Mr. Zach Torres-Fowler (co-author with firm partner Albert Bates Jr. of a notable article on the subject) will be presenting and engaging in Q & A from Philadelphia, PA.
- Zach Torres-Fowler is a senior associate with the law firm of Troutman Pepper Hamilton Sanders LLP in Philadelphia and New York where he specializes in complex international and domestic construction arbitrations. As part of his practice, Zach has represented clients in connection with disputes concerning projects around the world. Zach is also an adjunct professor at Charles Widger School of Law at Villanova University where he teaches courses on international commercial arbitration
