Since the beginning of the pandemic in March 2020, mediations have made increasing use of remote videoconferencing. The learning curve of mediators, attorneys, and participants has caught up with this form of communication which offers cost savings, efficiency, and the ability to easily bring all necessary participants “to the table.” However, remote communication triggers ethical considerations that mediators and attorneys should be aware of, and this will be covered by the presentation. Does remote technology put the participants on an unequal footing? What challenges to maintaining confidentiality are presented by a remote mediation? And how can the mediator, without the benefit of a reporter or a courtroom, ensure that the parties are voluntarily entering into a settlement agreement?
Phyllis Pollack, the principal of PGP Mediation, has conducted over 3000 mediations. She is a past chair of our State Bar’s ADR Committee and has served on the board of the California Dispute Resolution Council. She is a past president of the Southern California Mediation Association and of the SCMA’s Education Foundation. She is a member of the National Academy of Distinguished Neutrals. She is an adjunct professor at USC’s Gould School of Law, teaching Mediation Ethics and Employment Dispute Mediation, and has also taught Negotiation Theory and Application.
